These Terms & Conditions govern the access to and use of FestiO, a software platform developed and provided by SwaRu Technologies.
By accessing or using a FestiO-powered website, application or service, the user acknowledges that they have read and understood these Terms and agree to be bound by them to the extent applicable.
FestiO is a technology platform. It is not a Mandal, festival committee, event organizer, financial institution, payment processor, charity, trust, society or government authority. FestiO is provided to organizations to help them manage their own activities and information.
FestiO provides software functionality that may include:
Features may vary depending on the package, configuration, subscription, hosting arrangement and agreement between SwaRu Technologies and the organization.
The organization using FestiO is solely responsible for its activities and for information entered into the platform.
This includes responsibility for:
Organizations and authorized users are responsible for all content uploaded, entered or published through FestiO.
Users must not upload or publish content that is unlawful, defamatory, fraudulent, abusive, misleading, infringing, obscene, discriminatory, threatening or otherwise prohibited by applicable law.
SwaRu Technologies reserves the right, where reasonably necessary and legally permitted, to restrict, remove, disable or suspend content or access that may violate these Terms or create legal, security or operational risks.
The FestiO software, source code, design, architecture, database structure, workflows, interface components, branding, documentation and underlying technology are owned by or licensed to SwaRu Technologies unless otherwise agreed in writing.
The organization retains ownership of its own content, information, photographs, logos and materials submitted to FestiO, subject to the rights required to operate the service.
No user or organization receives ownership of the FestiO source code or underlying software merely by purchasing, subscribing to or using the platform.
Subject to the applicable commercial agreement, SwaRu Technologies grants the organization a limited, non-exclusive, non-transferable and revocable right to use FestiO for its intended organizational purposes.
The organization must not copy, reproduce, resell, sublicense, reverse engineer, modify, distribute, extract or commercially exploit the FestiO software or source code except where expressly authorized in writing.
The organization is responsible for maintaining the confidentiality of administrator credentials and for all activities performed through authorized administrator accounts.
If credentials are compromised, the organization must promptly notify SwaRu Technologies and take reasonable steps to secure the account.
SwaRu Technologies will make reasonable efforts to keep FestiO available and operational.
However, uninterrupted availability cannot be guaranteed.
Service interruptions may occur due to maintenance, upgrades, hosting problems, internet connectivity, infrastructure failures, cyber attacks, security incidents, third-party service failures, natural events, governmental actions or other circumstances beyond the reasonable control of SwaRu Technologies.
Although reasonable measures may be taken to protect information, SwaRu Technologies does not guarantee that data will never be lost, corrupted, damaged, unavailable or compromised.
Organizations should maintain appropriate independent records and backups of critical information.
FestiO may provide functionality for displaying, recording or facilitating donation-related information.
SwaRu Technologies does not act as a bank, payment processor, financial advisor, trustee, charity or financial custodian.
The organization is solely responsible for the legality, accounting, taxation, receipt, utilization, refund and reporting of donations and other financial contributions.
Where third-party payment gateways are used, the transaction is additionally subject to the terms and policies of the relevant payment provider.
FestiO only provides technology for displaying and managing event information.
SwaRu Technologies is not responsible for the organization, cancellation, postponement, safety, legality, quality, conduct, attendance, venue, transportation, crowd management or outcome of any event organized using FestiO.
FestiO may depend upon third-party services including hosting providers, payment gateways, email providers, SMS providers, cloud services, mapping services and other technology providers.
SwaRu Technologies is not responsible for failures, downtime, security incidents, policy changes, pricing changes or other actions of independent third-party providers.

SwaRu Technologies may suspend or restrict access to FestiO where reasonably necessary because of:
To the maximum extent permitted by applicable law, FestiO is provided on an "as available" and "as is" basis.
SwaRu Technologies does not warrant that the platform will always be uninterrupted, error-free, completely secure, compatible with every device or suitable for every particular organizational requirement.
SwaRu Technologies does not provide legal, financial, accounting, taxation, event-management, medical or other professional advice through FestiO.
To the maximum extent permitted by applicable law, SwaRu Technologies shall not be liable for indirect, incidental, special, consequential or punitive losses, including loss of profits, revenue, business opportunity, goodwill, reputation, anticipated savings or data, arising from or relating to the use or inability to use FestiO.
SwaRu Technologies shall not be responsible for losses arising from content, instructions, transactions, activities, representations or decisions made by the organization or its users.
SwaRu Technologies shall not be responsible for events, donations, financial disputes, member disputes, sponsor disputes, venue disputes, public complaints or other matters arising from the organization's activities.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.
To the maximum extent permitted by applicable law, the organization agrees to defend, indemnify and hold harmless SwaRu Technologies, its owners, employees, contractors and service providers from claims, losses, liabilities, damages, costs and reasonable expenses arising from:
SwaRu Technologies shall not be responsible for failure or delay caused by circumstances beyond its reasonable control, including natural disasters, fire, flood, epidemic, war, civil disturbance, governmental action, internet failures, power failures, infrastructure failures, cyber attacks, hosting failures, strikes or failures of third-party service providers.
SwaRu Technologies may modify these Terms from time to time. Updated Terms may be published on the website or otherwise communicated to the organization.
Continued use of FestiO following applicable changes may constitute acceptance of the revised Terms, subject to applicable law and contractual requirements.
These Terms shall be governed by the laws applicable in India.
Subject to applicable law, disputes relating to the FestiO software service shall be subject to the jurisdiction of the competent courts having jurisdiction over the principal place of business of SwaRu Technologies.
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall continue to remain in effect to the extent permitted by applicable law.
These Terms, together with any applicable commercial agreement, order form, proposal, service agreement or written agreement between SwaRu Technologies and the organization, constitute the understanding governing the use of FestiO.
Where a signed commercial agreement contains terms that expressly override these Terms, the applicable signed agreement shall prevail to the extent of such conflict.
